This Privacy Policy describes how your personal information is collected, used, stored, retained, protected, and shared when you visit or make a purchase from DataCarePH.com (the “Site”).

At DataCarePH, we respect your privacy and recognize your rights to privacy. We are committed to protecting the personal information that you provide to us. We comply with the fundamental principles of privacy as required by Data Protection Laws, such as, but not limited to, Republic Act No. 10173 also known as Philippine Data Privacy Act of 2012, its implementing rules and regulations, the General Data Protection Regulation (GDPR) of the European Union, and the California Consumer Privacy Act (CCPA).

We keep your personal information in confidentiality in the extent of adherence to the fundamental principles of privacy as required by Data Protection Laws, such as, but not limited to, Republic Act No. 10173 also known as Philippine Data Privacy Act of 2012, its implementing rules and regulations, the General Data Protection Regulation (GDPR) of the European Union, and the California Consumer Privacy Act (CCPA).

How we collect your personal data and what we collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

  • Google Analytics acquires user data from each website visitor through the use of page tags. A JavaScript page tag is inserted into the code of each page. This tag runs in the web browser of each visitor, collecting data and sending it to one of Google’s data collection servers.
  • We will update this section if we have some other tracking technologies including 3rd party services.

We also collect personal information when you make a purchase or attempt to make a purchase through the Site. This includes your name, billing address, shipping address, payment information (including credit card information, G-Cash, Maya, Grab Pay, Paypal), email address, and phone number. We refer to this information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

How do we collect and store your data?

You may reach us through our electronic modes of communication, through our website, apps, chat services, social media platform, and email. As you communicate with us, we collect the data you directly supplied through our contact form, newsletter, and live chat.

Furthermore, we collect and store your data when you:

Register online or place an order for any of our products or services. Voluntarily complete a customer survey or provide feedback on any of our message boards or via email, and live chat communication embedded in our website.

DataCarePH may also receive your data indirectly from the following sources:

  • Email
  • Social Media Platform (i.e. Google, Facebook, Youtube, Twitter)

In most cases when you visit our website, your internet browser such as Google Chrome, Mozilla Firefox, Safari and alike are silently storing information such as Local Storage, Sessions, and Cookies for a better User Interface (UI / UX) experience. We set expiry on those data or destroy session cookies when you logout.

Also we store your information in our database and we immediately remove your provided information if you unsubscribe to our service, newsletter, or set your individual privacy policy settings.

How do we use your personal information?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to: Communicate with you;

Screen our orders for potential risk or fraud; and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

If it is your first order from us, probably we are going to reach you out for the purpose of Proof of Transaction.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Data Retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

The Site is not intended for individuals under the age of 13.

California Consumer Privacy Act (CCPA)

If and to the extent DataCarePH is processing Personal Data on behalf and in accordance with the documented instructions of Customer within the scope of the CCPA, DataCarePH makes the following additional commitments to Customer. DataCarePH will process the Personal Data on behalf of Customer and will not sell the Personal Data as the term “selling” is defined in the CCPA. – share, rent, release, disclose, disseminate, make available, transfer or otherwise communicate orally, in writing or by electronic or other means, the Personal Data to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, including transactions for cross-context behavioral advertising in which no money is exchanged.

Retain, use or disclose the Personal Data for any purpose other than for the business purposes specified in the DPA Terms and the DataCarePH Customer Agreement, including retaining, using or disclosing the Personal Data for a commercial purpose other than the business purposes specified in the DPA Terms or the DataCarePH Customer Agreement, or as otherwise permitted by the CCPA.

Retain, use or disclose the Personal Data outside of the direct business relationship with Customer. combine the Personal Data with personal information that it receives from or on behalf of a third party or collects from California residents, except that DataCarePH may combine Personal Data to perform any business purpose as permitted by the CCPA or any regulations adopted or issued under the CCPA.

Risk Involved

We recognize the risks involved in the processing of personal information, such as, but not limited to, exposure to malware, ransomware, computer viruses, or unauthorized access. However, we are implementing appropriate organizational, physical, and technical security measures to ensure that any risk for personal data breach is mitigated, if not completely avoided.

Amendments to our Privacy Policy

We send notification to all users for any changes to our privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
